Poor lad :(

Lots of tlc from Mummy will make him feel much better.

:luck: WHEN I HEARD FROM YOU YESTERDAY AND YOU TOLD ME OF THE ATTACK, I HAVE TO ADMIT I WAS IMAGINING ALL SORTS OF INJURIES. I HAVE SEEN WHAT A RIDGEBACK CAN DO AND I DIDN'T THINK YOUR DOG WOULD HAVE COME OFF AS GOOD AS IT HAS. THE INJURIES ARE HORRIFIC, BUT I HAVE TO SAY THEY ARE NOT AS BAD AS THOSE THAT COULD HAVE BEEN. I CAN'T BELIEVE THAT SOMEONE WOULD HAVE A DOG OF THAT SORT OFF THE LEAD AND ABLE TO DO THIS TO YOURS. HAVE YOU INVOLVED THE POLICE, 'COS THIS IS THE SECOND SUCH ATTACK IN AS MANY WEEKS. STEVE FROM THE "HALL", WAS ATTACKED BY A LOOSE DOG AND ALTHOUGH HIS DOGS WERE TRAUMATISED, STEVE CAME OFF WORSE AS HE WRESTLED THE OTHER DOG OFF HE WRENCHED HIS BACK BADLY AND HAS LOST A WEEKS WORKS AS A RESULT. IN HIS CASE THE POLICE ARE INVOLVED AND WE AWAIT THE OUTCOME. AT THE MOMENT IT IS ALL VERY FRESH IN YOUR MIND AND YOU ARE STILL IN SHOCK, BUT, PAT, JUST THINK HOW MUCH WORSE IT COULD HAVE BEEN. I KNOW MIDAS WILL HAVE THE BEST OF CARE AND YOU WILL GET HIM RIGHT, PHYSICALLY. THE MENTAL EFFECTS MAY TAKE A BIT LONGER, BUT I KNOW YOU'LL GET THROUGH IT WITH THE SUPPORT OF YOUR FRIENDS. YOU KNOW WHERE WE ARE!

Havent spoken to Police yet because on a previous occasion when Frank was set about by another dog I was told by them

that its not a police matter. Its 'Dog on Dog' If a human is bitten its another matter but they are not interested in dogs fighting.

Frank was on a lead when this patterdale charged him, knocking me over so I dropped the lead and Frank was chased all over

the playing field. Luckily it was muzzled so when it got him down he was only bruised.

Midas was off lead with his brother over the farm field so I dont suppose anything will be done if I did complain. This dog has

attacked other dogs. If you walk past her house it tries to jump over the wall to get to your dogs. One day it will make it over.!!!

Perhaps I could ask for it to be muzzled when out.

There are no ther places to exercise dogs round here within walking distance.,and with my leg I can't walk miles anymore.

Don't feel like going out anymore. Sorry for rant. Feel pissed off.

Ouch! poor dog :( Hope the poor dog makes a swift recovery!

I know its easy to blame the dog but in my eyes the blame 110% lies with its OWNER! if the dog was raised correctly this kind of thing would never happen, Its a shame we cant have such idiotic owners put to sleep!

Poor lad! :(

Hope your feeling better soon Midas. :luck:

Take him to the vet, get a copy of the bill and post it to her with a month to pay with a proviso that if she fails to pay you will issue civil proceedings under section 2 of the dogs act 1871.

Section 2 Dogs Act 1871This is a civil complaint, although as it is heard in a Magistrates' Court, it is often (wrongly) said to be criminal. It occurs if a dog is not kept under proper control and is dangerous. Generally is dog is regarded as not being under proper control if it is neither on a lead nor muzzled.

Unlike Section 3 of the Dangerous Dogs Act 1991:

it applies regardless of where the incident takes place

proceedings can only be brought against the owner

a dog can show itself to be dangerous in its general behaviour, not just its behaviour towards a person

a single incident is generally insufficient to prove that a dog is dangerous, unless the Court believes that the single incident is exceptional

there is no presumption in favour of destruction of the dog

the Police have no power to seize a dog pending proceedings

the Court has no power to fine or order compensation

The Court has unfettered discretion on what to do to the dog. They may order destruction of the dog but such orders are very rare. The alternative is a Control Order (with or without conditions) and the owner will probably have to pay costs.

You can also report to the police that the dog is a dangerous dog, out of control, in a public place based on the fact it is attacking passers by and you feel it will escape and attack.

another comment (and I hope your poor Midas soon recovers) - if the police fob you off by saying it's a dog on dog attack (ie this is seen as "normal", not a caring dogowner's view but anyway ..) you can point out how frightened you were that YOU were going to be attacked as well. In the law these days it is enough for a person to feel threatened, not that they have to have been attacked by a dog - if they FEAR an attack they have a case. Or so I am told. I hope you get somewhere - next time it could be an elderly person with a dog, or a small child.

I went to check up on the DDA 1991 and below it states the bit I was trying to remember earlier

Dangerous Dogs Act 1991 (section 3)

It is a criminal offence (for the owner and/or the person in charge of the dog) to allow a dog to be ‘dangerously out of control’ in a public place, a place where it is not permitted to be, and some other areas. A ‘dangerously out of control’ dog can be defined as a dog that has injured someone or a dog that a person has grounds for reasonable apprehension that it may do so. Something as simple as your dog chasing, barking at or jumping up at a person or child could lead to a complaint, so ensure that your dog is under control at all times. If your dog injures a person, it may be seized by the police and your penalty may include a prison sentence and/or a ban on keeping dogs. There is also an automatic presumption that your dog will be destroyed (unless you can persuade the court that it is not a danger to the public, in which case it may be subject to a control order). You may also have to pay a fine, compensation and costs.

So a person does not have to be attacked by a dog - just "reasonably apprehensive" that a dog may attack them. You may feel like that when a dog attacks your own dog.

sorry to hear midas was attacked i agree with alsh its the stupid owners who allow their dogs do these things. hope u and midas feel better asap x

Pat i'm really sorry to hear about the attack on your lad, hope he heals very quickly poor lad.

These things shake you up so much as i know having had my lads attacked by a boxer dog in the village where i live, mine were on lead and it wasn't and while trying to stop it getting hold of Mr Whippet it had me instead resulting in some holes in my hand and a lot of shock. I sent the owner a letter telling her if it happened again i would report her to the police and maybe she should consider a muzzle for the dog! The following week a staffie came at me and the dogs while i was out in the village and by luck was wearing a harness and i managed to catch it as it came at me, left me feeling rather persacuted so i don't walk my dogs in the village any more and put them in the van & go somewhere else. Really feel that these people shouldn't have animals if they are not prepared to be responsible owners.

Hope you and Midas feel much better soon & i should definately send the offending owner the vet bill.

Jo & gang

Sorry to read about Midas. I hope he recovers well from his ordeal :luck:

Poor boy, i hope both him and you recover quickly

i had one of my dogs ( chloe ) attacked a few year back by a staffie she needed 58 stitches , the owner took me to the vets where he told her to bring the dog down to be destroyed, and if she did'nt he would inform the police, because once they get the taste of blood it would do it again, hope this helps and midas gets over her traumatic experiance,

Sorry to hear about Midas pat hope he well soon :luck:

Really sorry to hear about this Pat, and I hope Midas makes a full recovery

my old girl was attacked by a GS and it totally ruined her quality of life.

In my case the attack was witnessed by another person, My own vet gave a written

submission that her wounds were caused by dog bites, and I knew where the owner

lived just before my case came to the small claims court the owners paid the vet bill

for the initial attack there was ongoing treatment that they refused to pay for

- but in myopinion I could never have put a price on what changed a lovely lively old

girl into an old nervous wreck who never enjoyed a proper walk again - I could have

cheerfully shot the dog that caused the injuries but in hindsight it is the owners fault

not the dog. I still meet owners walking a totally out of control dog - one that is almost

dragging them over to get to mine - the most common comments made "how do you

keep all those dogs ( 8) so well behaved", or the most annoying "he/she only wants to play"

- my reply being your dog showing its teeth, barking growling and dragging you all

over the place is not of sign of wanting to play you f!!!ing moron

(w00t) TOO RIGHT ELAINE. THERE'S NO SUCH THING AS A BAD DOG, JUST IDIOTIC OWNERS WHO STILL HAVE IT THEIR HEAD THAT "IT'S ONLY PLAYING" SOME PEOPLE SHOULDN'T BE ALLOWED TO OWN A DOG, BUT WHAT'S EVEN MORE WORRYING IS THAT SOME OF THEM BREED THEMSELVES! WHAT HOPE FOR THE FUTURE! MORE MORONS!

Midas seems to be recovering. Wounds still weeping because he lies on that side (Right)

At moment he is in the chair on his left side with his ointment on. How long he will stay

that way is anyones quess ! He still is very worried, won't let me out of his sight. Whinges

when he can't see me.

I decided to inform Police and asked if they would recommend that she muzzles it.

Still waiting to hear from them.!!

Thanks to all for good wishes. Pat and Midas. xxxx

 SO SORRY THAT HE'S STILL FEELING INSECURE, BUT AFTER WHAT HE'S BEEN THROUGH, IT'S HARDLY SURPRISING! IT'LL TAKE A WHILE FOR HIM TO REGAIN HIS CONFIDENCE AND ALL YOU CAN DO IS LET HIM KNOW THAT YOU'RE THERE FOR HIM. I'M SURE YOU'VE DONE THE RIGHT THING BY INFORMING THE POLICE, BECAUSE NEXT TIME IT COULD BE A CHILD AND "SHE" WON'T BE ABLE TO PLEAD IGNORANCE! WELL DONE PAT FOR EVERYONES' SAKE AND GIVE HIM A BIG HUG FROM US!
