Any advice appreciated on this. :))

Last year end of August i noticed one of my dogs had a lump appeared on her little toe so made an appointment at the vet & rang the insurance to let them know & ask for a claims form in advance which they sent dated 30th August 2006.

Took dog to vet & was advised it was fatty tissue, nothing to worry about but would be better to remove it in the long term.

So i made an appt to have the lump removed BUT a series of events delayed the op, i cant remember exactly but i think i had the op arranged for the 2nd week in September but my car broke down, i then re-arranged it only to find out that my vet was on holiday for 3 weeks, whatever, but the op finally went ahead on 16th October.

When i collected her later that day 16th October i also gave them the claims form to send off to the Insurance.

Today 01/02/07 i receive a letter from the Insurance telling me they are not going to pay the claim as they did not receive the insurance claim form from the vet until the 5th January 07!!

Basically the op was done 16th Oct 06 & the vet did not return the claim form until the 5th Jan 07 nearly 3 months later. (w00t)

However it does state in the small print of the insurance that a claim has to be returned within 90 days of the incident happening sooooooo.................if i asked for the claims form on the 30th August 06 & op was actually done on 16th Oct 06, it means 48 days had elapsed BUT the vet still had 42 days in which to return the form & he didnt. :- "

If the vet now demands that i pay the nearly £400, where do i stand ??? :blink:

Although i gave it to him on the 16/10/06 with still 42 days in which he could claim he may now say that he thought their policy was within 90 days so thought he had ample time in which to return it. Although i am pretty sure the claims forms have the date they are issued printed oon them. ;)

I have to ring the vet tomorrow so any advice would be greatly appreciated :thumbsup:

Upon reading what you've said, your vet is in the wrong for not sending the claims form in on time and you should not be liable to pay the bill.

I'd speak to you vet and find out exaclty why they didn't send the forms in good time and tell them what the insurance company has said, regarding not paying due to the forms been sent back too late.

agree. Once you handed the form to the vet it was up to them to submit forms within a reasonable time. Usually they're right on the case, so that they get paid! Mine did an interim claim and then a final claim with M&S when Josie's treatment for her wounds went on a bit, and that was all paid okay.

Do you have a choice about chaing vet when this is all sorted? I would!

Thanks, yes i do think it would be an idea to change, this isn't my normal long standing vet.

I just dont understand why they sat on the claim for nearly 3 months although i'm sure they will say the norm, either they were having refurbishments or new pc's upgraded! :- "
 
Well you already know my thoughts on this one Nik :angry: They are def in the wrong and if I were you I would be sticking with my long standing vet that I could trust in the future. :thumbsup:

Hope you get it sorted out soon,these things tend to drag out indefinitely. :(

I just would have thought that as long as you provided the vet with the claims form within a reasonable time to allow them to fill it in & return it to the insurers to make the claim you would have kept to your part of the bargain so to speak.

Surely you can not be held responsible once you have handed in the claims form for however long your vet takes to send it off? :eek:
 
Any news on the claim...what did the vet say???

Where is the practice?? Would it be poosible for you to just turn up, they really wouldn't like to have a discussion in front of other customers and you might get somewhere??
 
what a nightmare, when they took the claim form to complete - they took responsiblity to send it off and therefore they are at fault. if it states on the form the 90 day deadline and they failed to meet that - it is their error not yours. i would imagine you would have a strong case Nik
 
definately the vets fault and in good faith they should foot the bill if the insurance doesnt pay up.....I know when our dog was injured we just handed the forms to the vets and left them in charge of forwarding them on to the insurance......The practice that you used must be use to handling claim forms and know the importance of sending them back im time....
 
The last claim I had with Inca went through our practice, they were great and will do it that way again.

Keep on at them to sort it out.
 
whilst i worked as a nurse, my fellow nurse used to deal with all claims and would be able to send a filled claim form out within a week!! it really shouldnt take longer than that, the only reason i can think of is- they lost it, and found it later. or- they had hundreds to do...???

but it is their fault, and if they cant persuade the insurers to pay out, they should then pay it themselves...

[SIZE=14pt]Don't pay. Based on the info you give Your vet is in the wrong. He will have signed the form and stamped it with a practice stamp thus proving that he had it. Get the insurance company to send you a copy, make sure that they don't return it to the vet. If he/she is difficult I suggest writing to the BSAVA or BVA and mentioning to your vet that you will be taking this action. This is truly appalling service. It might be worth calling the insurance ombudsman for advice, they are pretty good.By the way, which insurance company is it? Not E and L by any chance?[/SIZE]

Oh you guessed it YES E & L (w00t)

Well the update is i have had absolutely no luck getting the Practice Manager to call me back BUT i have had another letter from the insurance saying "although they accept NO LIABILITY for this claim, in this instance they are going to make a one off payment out of good will :unsure:

However if a claim ever results from this same situation, unfortunately they will be unable to help as this is an en gratia payment :blink:

What the hell is this all about & why have they changed their mind :blink: :- " :eek:
 
OMG, I had decided to go with E and L as M and S have increased their premium by 70%. Luckily, I heard so many bad things, I cancelled the policys.
 
Oh gosh NEVER E&L - Have a read through any board - a HIGH HUGE majority of claims are denied for ridiculous reasons. Talk to any Vet practice and they'll tell you it's a nightmare to get money from them.

How very strange that they have had a change of heart...are they paying the full amount or just a percentage of the original claim??

I would still continue to get an answer from your vet cos they were still in the wrong for sending the forms back too late.

I think if I was you I would to change my insurance company.

The funny thing is, i know what a bad reputation they now have BUT i have to be honest & say that i have been with them now approx 8-9 years with ALL the dogs & whilst i haven't had a huge amount of claims, there has been a few ops for removing lumps etc & i have never had a problem with any of the claims.

They have never questioned any treatment or operation & have never before refused to pay up.

To be honest in this instance i think the vet is far more at fault for leaving it sooo long before returning the claims form.

I am just wondering if they have decided to pay up in view of the amount of years i have been with them? ;)
 
My advice Nina ,

Change vets and change Insurance companies . E & L (w00t) (w00t)
