We have a track which runs passed our house which is not a public right of way but walkers & horse riders use it as a short cut which we usually have no problem with till recently. Some kind person left the gate open & my horse escaped across a couple of open fields & onto the road.

Today 3 bull terriers ran riot through my ducks & chickens,luckily my OH was outside otherwise we may have lost them all. He told the dogs owners to put them on their f****ing leads, they're reply was " there's no need to be like that" They didn't even apologise or even ask if the birds were ok :(

Those sort of people really get on my nerves, and have you noticed it's always people like them that are the first to complain when access to anywhere is closed :rant: .

thats what society is like now,total lack of respect for anyone else.

yep - then there's those who get us all banned from parks and beaches by their insistance on their right to leave dollops of dog poo behind them!

Dog ownership, rambling, whatever, all come with responsibilities ..... i grew up in the country and remember being taught 'the country code' in school, always close gates, don't leave litter, ensure fires are out etc.

shame people think they can do what they like and b***er the consequences to anyone else.

I'm really hoping your horse and birds were unscathed mao :(
 
Birds survived thanks to my OH being nearby, they lost a few feathers & are a bit nervous about coming out but it could have been a lot worse :sweating: The horse was also very lucky, minor damage only.

Other gates have been left open & the cattle wandered onto the road again no animal or person was injured.

I think the worse thing is the way the dogs are left to run loose through the woods etc we tend to avoid the woods during the summer because there's deer with young at foot :wub: so we try not to disturb them. Also the game keeper has put the pheasant pullets out, the loose dogs scatter them in all directions. I have tried to warn some of these people that the gamekeeper is likely to shoot dogs round here but their response is less than polite :(
 
Other than locking the gate , how about putting a sign up , saying about young deer etc , Gamekeepers with guns , that sort of thing . As usual its always the minority that spoil it for the rest of us isnt it :rant: I might be tempted to lock it , my animals would come first Im afraid , perhaps you could give keys to the people you know ,

Im sure you know this but I think if a track has been used for a certain period as a bridlepath you cant close it even though its your land, of course I might be talking out of my a**s here :lol: Just a thought :huggles:

I'll ask Hugo, but I think you have to be very careful about what JAX said- she's right that after a certain amount of time it will become some sort of right of way. He advised my parents (in a similar situation) to lock the gate for some of the time, and keeps it ok, I'll check how long you have to lock it for.
 
i think that what is created is an EASEMENT

if a route is used regularly, without permission and without secrecy, then after a certain period (and 25 yrs does ring a bell - i went out with a law student many years ago) then there becomes a right to use the route.

there was a man in my village who doggedly used a route once a year, every year, to keep it open
 
We've had problems with people leaving the gates open on Port Meadow. There was a deliberate campaign by some evil person who would deliberately open them all late at night with a deliberate view of letting the horses and cattle onto the road (fortunately I was out even later and went round shutting them). The problem was resolved by rehanging the gate so that it closed itself (the phantom gate opener had a couple of goes after that then gave up).
