imo a lot of these farmers seem to think they are above the law. dont get me wrong im all for protecting livestock but only when there is a THREAT to their livestock.some of these guys seem to think  they are judge, jury and executioner.
Hi if their had been livestock in the field or if the dogs had been uncontrolable & dangerous an posed a threat yes i would have to say the farmer would have been in his rights, there was no livestock, the dogs were not uncontrolable or dangerous, the farmer knew who's dogs they were, he could have come to the house an told us to get the dogs out of the field or even phoned the police to have them removed as their was no livestock about to be in any iminent danger from the dogs, they were just playing with each other an posed no threat to anyone or anything including livestock, what he did was callous an vindictive an to gloat about it shows him for wot he is a total f*ckup retarded interbred hillybilly farmer with no regard or concern for anything not humans nor animals.

OMG I am so sorry for what has happened to your family and your dogs.

This farmer seems to think he can act above the law, please I urge you to get in touch with the police ASAP, if you get an attitude of "sorry, we aren't sure, don't know what to do about this" (as sometimes happens when you phone the non-emergency number) then ask to speak to that employee's superior.

Take it as high as you can go, it would seem that criminal offences have been caused by the farmer.

He needs stopping before he goes further and hurts people as well as killing animals. What an inadequate person he sounds. And how callous and inhuman, to gloat about killing dogs. He is pathetic.

Good luck, and again I am very sorry for your loss.

Gill

As far as the law is concerned, it is an offence to discharge a shotgun within "50 feet" of the center of a highway/road.

Ive only just flicked quickly through this thread, but the mere fact that this farmer entered your property with a shotgun should be enough to get the police involved.

He would also have to prove that the dogs were worrying livestock.

As a former keeper, i am suprised that this farmer has taken such drastic action over nothing, i beleive that you have a case against him and would most probably win in court.

At the very least his actions should be enough for the police to revoke his license.

So sorry about your dogs :( it is terrible. These farmers in question sound dreadful people

I work on a farm and know lots of farmers round here, none like those Im pleased to say.

Yes I would pursue it too - I dont think in this case he was within his rights - especially if the dogs were not chasing livestock. and to fire a shotgun like that around your family is dreadful.

I am so sorry to hear of your sad loss. That is just heartbreaking and you and your family must be so very distraught and you must be at your wits end with grief. I do hope you take this matter further and get some kind of prosecution, you must have rights. I bet you feel like taking the matter into your own hands. I stayed in a village called Heriot in the borders when I was younger and I have witnessed the cruelty that the local farmer inflicted on his poor working collies and the poor lambs and sheep in the field adjoining my garden.

Good luck

Dont give the B*****d the satisfaction of having you getting into trouble. Do it legally and he'll not know whats hit him.

No, don't do anything illegal yourself! Don't lower yourself to his level ... and it would be sod's law (scuse language) that you would get into more trouble than he should.

Do it right, thru the police/solicitor or whatever, you've got right on your side.

There must be proper channels you can go through to get this sorted. He sounds a nutcase and you don't want to put your family through more heartache or risk.

where in the country are you?
A little village called Egton 6 miles outside Whitby North Yorkshire

My God, this has made me feel sick. Firstly because of the whole story, secondly because I have just come back from holiday in Egton.

We are very careful about letting our dogs off but we got to a field (near the Hole of Horcum) and it said to keep dogs on a lead. There were no livestock so my boyfriend let them into the field. I just got this funny feeling about it and called them back. They came back and we left. It makes me feel ill now that something bad could've happened.

I am so sorry for what has happened to your dogs. I don't know what else to say. I had a lovely holiday but hearing this has put me off returning :(

Please do something about this :luck:

On the DEFRA website it states that...
Under the Act there is a defence available to someone who is the subject of civil proceedings for killing or injuring a dog that was worrying or about to worry livestock. The defence can be used where there were no other means of ending or preventing the worrying or where the dog that had done the worrying was still in the vicinity and not under control and there were no practicable means of establishing ownership.

Also posessing a firearm with intent to cause fear or unlawful violence carries a maximum sentence of ten years & an unlimited fine.

Trespassing with firearm in building/on land, maximum penalty seven years & unlimited fine. (Both from BASC website).

Hope that helps

That sounds pretty clear that even if a dog is worrying livestock then shooting is a last resort and that attempts have to be made to establish ownership and/or control over the dog

Hi thks i know as hard as it is I av to bite my tongue an let the relevant authorities deal with it.

I am going above the police officers heads & going straight to the chief constable & also seeking legal advice.

I have took photos of Pippa & Tiegan & the holes in their heads ( about the size of a penny ).

I have also took photos of the empty field they were in & were they were when shot & how close to a public highway & also houses they were when shot.

I will be taking them both to the vets to be froze & a post mortem done.

We thank you all for your advice, compassion, concern & kindness, I must stress talking about it an sharing it has helped me imensely in keping my temper under control. & I hope it will continue.

Obviously as it will be an ongoing investigation I wont be able to discuss certain matters & details, but i will keep you all informed of what i may disclose.

Kind regards to you all Dave Paula & Family

Ps please keep the thread going & any advice will be greatfully received.....

Just caught up with this. So so sorry to hear this horrible tale, I have nothing to add, only to echo everyone else's sentiments and advice.

Do please keep us updated, so many people here on k9 will be thinking of you.

The farmer deserves to be shot.  What an absolute b****rd. I do hope you are able to get him prosecuted and also ensure there is plenty of publicity. Please do keep us all informed of how things are going.

RIP Pippa and Tiegan.
