BALDRY and LODGE are jointly charged with an offence of murder. At the trial for the offence, BALDRY's defence team submit that when she committed the offence she was suffering from pre-menstrual symptoms and consequently her defence will be one of ‘diminished responsibility’.

Explanation

Answer A — The burden of proof does rest with the defence. If two people are charged with murder and one party successfully raises the defence of diminished responsibility, this will not alter the fact that the co-defendant is still charged with murder. Pre-menstrual symptoms have been accepted by the courts as diminished responsibility (R v Reynolds [1988] Crim LR 679). A person must suffer from a substantial, not minor, lapse of lucidity for the defence to be applicable.
